My son broke up with his girlfriend of 3 yrs. They broke up and she told him to keep in touch and be friends. He called her and she went nuts.Next thing we know he is in jail for harassing communications. Even though he does not have a cell phone she claims the calls came from a cousins phone. Now he was forced to take a plea and is on probation for 2 yrs. So unfair that witch . She had no proof of any calls coming from him .It was a he said she said and he lost deal. The lawyer felt it best to not chance a jury trial. I think the system let him down.

There seem to be a lot missing there. Somebody, maybe your son is not telling the WHOLE truth. It seem almost unbelievable that he would just call to say hi, and she have him locked up.
It is believable he would call to say hi and she would lock him up, however it would require past actions as well. There is no way the cops are going to drag him in and give him two years on a first offense. Not in the US at least, which is where I believe you are located, correct? Did they argue while they were together? Domestic violence/domestic disputes? Was there issues with moving out finally and getting stuff? Is he calling from his cousins or is he there while someone else calls? All this would lead to jail time but it wouldn't be a "first" offense.
How the hell is a single phone call considered harassment? Someone isn't telling the whole truth here, get a good look at all the evidence against him, because a single call will not land you in jail for harassment, nor put you on two years probation.
So she claimed that there were several calls from a cousins phone? I think that you would have actual evidence than just somebody's word. I think that we would need both sides of the story.
Yea something has to be missing here, most of the time its like 3 calls in a 24hour time span or close to that. I had to read up on it once, before filing myself for an ex of mine that just wouldn't go away. Something is missing, and the evidence, what did the phone records state?
